Privacy Policy

Preface:
On May 25, 2018, the new Regulation (EU) 679/2016 on Data Protection, the so-called GDPR (General Data Protection Regulation), will enter into force in the European Union. This regulation concerns the protection of natural persons with regard to the processing of personal data and the free movement of such data.
SABOIL S.A.S., as the data controller of your data, is fully aware of the resulting responsibility and has therefore updated its privacy policy to more clearly communicate the information we collect, why we do so, and your rights as the owner of the data you have entrusted to us. Furthermore, while maintaining the already strict control rules, we have strengthened our controls to improve the protection of your data and further protect your privacy.
Data Controller
The Data Controller is SABOIL S.A.S., represented by its legal representative. SABOIL S.A.S. is responsible for the correct and lawful use and storage of your personal data. You may exercise your rights by contacting SABOIL S.A.S. at the contact details provided at the bottom of this document.
Data Processor
The Data Processors are responsible to you for the correct and lawful use of your personal data and may be contacted for any information or requests. You may access the names and contact details of the Data Processors by submitting a written request to the contact details provided at the bottom of this document.
Nature of data collected:
In order to provide you with our products and/or services and to respond to your requests (information, demonstrations, quotes, updates, etc.), our company needs to collect some of your personal data. This data may include, for example: personal details, contact details and names, telephone numbers, email addresses, tax code and/or VAT number. Data relating to offers issued (even if not accepted), orders placed, and all data relating to the pages visited while browsing our website may also be collected and stored. Please note that the data collected for registration and/or purchases made on your behalf from third parties (for example, domain registration or the purchase of templates and/or web forms) will not be stored and/or processed in any way by SABOIL S.A.S., which will only act as an intermediary, with your specific consent, with the service provider, and that such data will be processed by them as data controllers.
Please also note that any credit card data used to make payments on the site (card number, cardholder name, expiration date, security codes, etc.) will be collected by the payment service provider, who will act as an independent data controller. This data will not be transmitted to SABOIL S.A.S. servers, and therefore, SABOIL S.A.S. will not process such data in any way.
In any case, for the purposes set out below, the provision and subsequent collection of personal data classified as “sensitive” (see Art. 9 of Regulation 679/2016) will never be required.
Purpose:
Your personal data is collected and processed for the following purposes:
1. To enable you to access the product download area and thus provide you with the ability to download demos, program updates, and/or related documentation.
2. To respond to your requests for information about our products and/or services and, in general, for any preliminary requests prior to finalizing a specific order/contract (e.g., preparing estimates, offers, etc.).
3. To perform the operations envisaged in the contracts entered into (supply of products and services, any subsequent technical support, management of collections, payments, etc.) and which may be entered into in the future (see Art. 6 C.1 Letter b of Regulation 679/2016).
4. To fulfill administrative, tax, accounting, and other obligations and requirements arising from contracts entered into, as well as those required by applicable legislation, regulations, and EU legislation (see Art. 6, Paragraph 1, Letters b and c of Regulation (EU) No. 679/2016).
5. To fulfill instructions issued by authorized authorities and supervisory and control bodies (e.g., inspections by the Tax Authority) (see Art. 23, Paragraphs 1 and 2 of Regulation (EU) No. 679/2016).
Processing methods:
The data will be processed primarily using electronic tools and stored on both computer media and any other suitable media, in compliance with the provisions of Art. 32 of Regulation (EU) No. 679/2016 and Annex B of Legislative Decree No. 196/2003.
N.B. – Please note that, in the event of technical assistance, our staff will access your data only with your specific consent. Your data will be processed confidentially and only for the time necessary to complete the requested task.
Nature of provision:
Providing your personal data is optional, but refusal to do so will make it impossible for SABOIL S.A.S. to process your registration on the website and your requests for quotes, offers, orders, and contracts, as described in points 1, 2, 3, and 4 of the “Purpose” section. Therefore, providing the data necessary to fulfill legal obligations related to the purposes indicated in the previous points is mandatory.
Scope of communication and dissemination:
In addition to the data controller and data processors, certain specific categories of parties external to our company may also become aware of your personal data, acting as external data processors, for purposes related to the fulfillment of obligations arising from contracts entered into with you or obligations required by laws, regulations, etc. These categories include, for example:
Accounting firms, administrative and accounting data processing centers for company records, balance sheet maintenance, accounting processing, etc.
Laboratories and service centers that handle the installation, testing, configuration, and repair (whether under warranty or not) of your equipment.
External parties performing functions related to the execution of the contract (carriers, transporters, etc.).
Your personal data may also be disclosed to parties granted access to the data by law or regulations (Financial Police, Police Forces, etc.).
No dissemination of your data (sharing your data with an indefinite number of parties) is envisaged.
User Rights:
The Data Subject, pursuant to Articles 15 to 22 of Regulation (EU) No. 679/2016 and Article 7 of Legislative Decree no. 196/2003, you have the right to:
1. Obtain confirmation as to whether or not personal data concerning you exists.
2. Obtain information regarding the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed, and, where possible, the retention period.
3. Obtain rectification (through appropriate authentication on the portal within your reserved area) and erasure of your data.
4. Obtain data portability, i.e., receive your data from a data controller in a structured, commonly used, and machine-readable format, and transmit it to another data controller without hindrance.
5. Object to processing at any time (where permitted by applicable law, see Art. 6 C.1 Letters b and c of Regulation 679/2016), including in the case of processing for direct marketing purposes.
6. Request from the data controller access to, rectification or erasure of, or restriction of processing concerning the data subject, or object to processing, as well as the right to data portability.
7. Withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
